Jack Cards - Connect Thoughtfully

Any member or other user (together defined as “User”) of the Jackcards.com website, published by Jack Cards LLC (“Jack Cards”), by using the website, agrees to abide by the Terms of Use contained herein. User agrees to have read and understand the Terms of Use, Privacy Policy, and Security Policy before proceeding to use the website. User agrees to abide by all policies and accept all risks stated therein. The Terms of Use explain what User can expect from using the site and identify User’s rights.

Jack Cards sells greeting cards, gift cards, and/or other items though its website and online organizational system. To purchase cards, User signs up for an account, creates a Google Checkout account, and purchases cards. At any time, at the request of User, Jack Cards will close User’s account. Jack Cards will not refund balances obtained through promotions and/or gift cards.

User has the option to provide personal information to assist Jack Cards in helping User search for the most appropriate greeting cards to purchase. Jack Cards is not in the business of selling any personal information. For more information on Jack Cards and privacy, see Jack Cards’ Privacy Policy. User can add contacts, such as friends and family, to Jack Cards’ contact-management system. User can provide personal information regarding such contacts—such as hobbies, birthdays, and mailing addresses—to assist Jack Cards with the following: helping User pinpoint appropriate greeting cards for such contacts, reminding User to purchase cards for such contacts at appropriate times, assisting User to organize and time future card purchases for such contacts, and appropriately pre-addressing cards for such contacts.

Jack Cards emails User upon the shipment of a User’s order. Jack Cards uses one order fulfillment site, and utilizes the U.S. Postal Service for its shipments. If a card does not satisfy User in any way, User accepts that User’s sole remedy is to return the card to Jack Cards with a short description of User’s dissatisfaction for account credit. For certain orders, due to out-of-stock issues, Jack Cards reserves the right to replace the occasional envelope or card with a similar envelope or card; Jack Cards makes every effort to minimize such occurrences. As a benefit for its customers, Jack Cards will replace the occasional lost card free of charge. However, if the number of lost cards for a single User seems excessive, at the sole discretion of Jack Cards, Jack Cards reserves the right to terminate a User’s account and charge such User for all cards sent.

User agrees to receive electronic communication from Jack Cards. Jack Cards will make every effort to respect User’s account preferences with regards to communication. See Jack Cards’ Privacy Policy for more information on electronic communication. User accepts that electronic communication is sufficient for legal communication requirements when such communication must be in writing.

User agrees not to publish harmful or offensive messages publicly through the Jack Cards’ website, and User agrees not to act in an offensive, vulgar, or harmful manner while using the site. User agrees not to use the Jack Cards’ website commercially, or use the website for any reason other than to browse cards, organize accounts, read Jack Cards’ news and blogs, learn about Jack Cards’ services, and/or purchase items. User agrees not to post, email, or transmit any harmful programs to Jack Cards’ or any computer associated with Jack Cards, nor commit any act which may disrupt Jack Cards service or invade another user’s privacy. User agrees to respect Jack Cards’ and its card designers’ intellectual property and not to reproduce, copy, display, or create derivative works from any item purchased or sent from Jack Cards, or any visual from the Jack Cards website without the express written consent of Jack Cards. User acknowledges that the Jack Cards website and service contains content and/or parts protected by copyright and patent. User agrees not to copy or mimic the content or service of Jack Cards without Jack Cards’ express written consent. User agrees not to export by any means any Jack Cards’ content or description of any Jack Cards content or service to any foreign destination. User agrees to use the website in accordance with all applicable laws and not to impersonate others.

The Jack Cards website is designed for the use of adults and/or children under the supervision of adults. User must sign up for the service and ensure age before accessing any adult content. Adult content is available only if User specifically permits such content in the User preferences area of User’s account page. Users of the site, including children under the supervision of adults, have the opportunity to make public comments. Such information will by made publicly available. In order to protect the privacy of children under the age of 13, Jack Cards does not permit such children to make publicly-available comments.

The Jack Cards website contains links to third-party websites not controlled by Jack Cards. Jack Cards does not take liability related to the use of such websites, is not responsible for the content of such websites, and does not guarantee that the terms of use, security policies, and/or privacy policies of such websites conform to those of Jack Cards.

Jack Cards reserves the right to terminate User’s account at any time for any reason or no reason.

User agrees that, as Jack Cards is a Massachusetts LLC, jurisdiction for all disputes regarding Jack Cards shall be resolved within the Massachusetts legal system. User agrees to assert claims exclusively on an individual (non-class) basis.

Jack Cards does not guarantee uninterrupted service and access to the Jack Cards website. Under all circumstances, Jack Cards shall not be liable for damages relating to programs such as viruses transmitted to User from Jack Cards, including through the website and incidentally through electronic communication; or products received from Jack Cards.

Jack Cards reserves the right to make changes to this policy at any time, and User should check back for updates from time to time. Jack Cards, LLC (“Jack Cards”) knows that its users and customers (“User”) care about the privacy of their personal information and sincerely appreciates the trust its customers place in Jack Cards.

Personal information includes but is not limited to the names, passwords, email addresses, mailing addresses, phone numbers, birthdays, sexes, hobbies, and/or other such personal information or words associated with both User and User’s contacts. Jack Cards collects such information from User to facilitate the search of appropriate products and the organization of User’s life. Jack Cards also uses such information to contact User for order fulfillment, administrative issues, reminders, news, or other Jack Cards’ business as agreed to by User during sign up or in the “your account” section of Jack Cards’ website. Other than communication regarding order fulfillment and necessary administrative issues, User can at any time opt out of such communication in the “your account” section of the website. Jack Cards is not in the business of selling personal information and will not disclose or sell any personal information to any third party other than for the following reasons: 1) compliance with the law, 2) use of subcontractors and/or service providers hired to assist Jack Cards with its core business functions, 3) enforcement of Jack Cards’ Terms and Conditions, 4) protection of Jack Cards’ business, employees, and/or customers. Every subcontractor and service provider hired to assist Jack Cards with its core business functions has signed a confidentiality agreement precluding the use of personal information for any reason other than the task for which the subcontractor or service provider was hired.

Jack Cards, to improve the usability of its website, utilizes cookies and/or other technologies to keep track of customer usage. User is welcome to disallow the use of cookies via internet-browser settings. A number of companies offer utilities designed to allow User to surf the internet anonymously as well.

The Jack Cards website contains links to third-party websites. Jack Cards cannot guarantee the privacy of information collected by or submitted to such websites.

Certain sections of the website allow User to post comments to the public with a name and location associated with such comments; such comments with their associated names and locations may be publicly available on Jack Cards’ website.

Jack Cards LLC (“Jack Cards”) takes the security all personal information seriously and uses reasonable, industry-standard means to insure the safety of all such information. For example, Jack Cards uses Secure Sockets Layering, a commonly-used protocol for managing the security of a message transmission on the internet. Jack Cards also encrypts all the personal information of customers and any other users (together referred to as “User”) and stores such information on restricted-access computers located at restricted-access facilities.

Payments are administered through Google Checkout. Although Jack Cards considers Google Checkout a reputable site, it cannot assume liability for the security of information submitted to Google Checkout.

User is responsible for maintaining the confidentiality of personal information, including user name and password; for restricting access to personal computers and mobile devises; and for logging off following the access of public computers and/or any other devises used to access Jack Cards. As Jack Cards uses email to renew passwords, User is also responsible for maintaining the security of email accounts, which are unaffiliated with Jack Cards.

As no security system can guarantee to be 100% secure, Jack Cards cannot guarantee the security of User’s personal information nor can Jack Cards assume liability for improper access to it. By using the Jack Cards website, User agrees that Jack Cards can communicate with User electronically regarding security, privacy, terms of use, or any other administrative issues relating to the use of the site.
